The complaint made against Mr Jesús Ger with relation to the Camp Site Integrated Urban Development Plan (PAI) in Oropesa has been dismissed

Castellón’s Examining Court Number 2 has dismissed the complaint made against Mr Jesús Ger with relation to the “Camp Site” PAI in the “Les Amplaries” area of Oropesa del Mar.

The court’s judgement, dated the 5th of November, sets out that no evidence has been presented indicating that the President of the Marina d'Or Group, Jesús Ger, had committed corruption as per the plaintiff’s accusations, nor indeed that he had committed any other offence.

The judgement also declares that the approval of the Plan did not constitute an arbitrary or capricious act. In particular, the Examining Court Number 2 pointed out that, when it chose to ignore the report issued by Madrid’s State Coastal Agency (Dirección General de Costas) which had required the demolition of the Block of Apartments “Kiwu”, Oropesa’s town council did not commit any offence in opposing said demolition, given that there were reasons behind that opposition and that the report by the State Coastal Agency was not binding (the building had been constructed with the corresponding licence and was not located in the area of public terrestrial-maritime domain).

Additionally, it has been shown that the majority of people living in or owning property in the building, with the exception of the plaintiff, were opposed to the demolition of their homes.t is also the case that the plaintiff-accuser is the owner of the camp site situated behind the Kiwu apartment block, and that this camp site would have become eligible for multi-story development once the demolition had taken place.

It was also the case that the plaintiffs, the Sanchis Vanhaverbekes, are associated with the PABRAMA construction company which was unsuccessful in the tendering process for carrying out the PAI precisely because they had proposed said demolition. Purely for information purposes, and without in any way implying judgement of intent, it should be pointed out that the wife of the plaintiff Mr Sanchis Vanhaverbeke, was working as a functionary in the State Coastal Agency.

The Marina d'Or Group is studying the possibility of taking legal action against the plaintiffs and others for false accusation and for other motives. The damage that has been produced due to the accusation is important given that many in the media, especially in the Internet, have published the story without making clear that, while the Court had agreed to examine the complaint, it had never accepted the grounds of the same and that, now, it has completely rejected it as unfounded.

The Marina d'Or Group feels that the complaint was a case of irresponsible use of penal law to further private interests with the intention of creating an unfounded state of social alarm as an inappropriate pressure tactic to the advancement of private ends.
